INTRODUCTION

Janeen Kydd-Smith, Director of Kydd-Smith Environmental Planning Ltd, has over 25 years’ experience in environmental planning, policy formulation and analysis, and senior management in the local government and private sectors.  Janeen’s specialist areas include project management, policy analysis, development and review, district plan preparation and review, hearing decision writing, submission processes, due diligence, public consultation, preparation of resource consent applications, and preparation and presentation of planning evidence at district council and Environment Court hearings.

  • Hastings District Council, Brookvale Road: - wrote a pre-hearing meeting report and a decision report on behalf of the Council Hearings Committee in relation to a hearing of a water permit application to take water from 3 bores that were deemed as depleting the Karamu Stream (2008).
     
  • Karamu Stream Catchment: wrote a pre-hearing report and a decision report on behalf of the Council Hearings Committee in relation to the hearing of 25 replacement resource consent applications and 6 new resource consent applications from various applicants to take water from the Karamu Stream catchment. (2008)
     
  • Ngaruroro River Catchment: wrote a pre-hearing meeting report and a decision report on behalf of the Council Hearings Committee in relation to the hearing of 67 replacement resource consents applications from various applicants to take water from the Ngaruroro River catchment (2008/2009).

Discharge Permits

  • Taharua Farm Limited: wrote a pre-hearing meeting report and a decision report on behalf of the Council Hearings Committee in relation to the hearing of an application to discharge dairy effluent to land (2008).

Cost Objections (s357 Resource Management Act 1991)

  • Wrote decision reports on behalf of the Council Hearings Committee in relation to the hearing of a number of objections from applicants and resource consent holders to costs associated with processing resource consent applications (2008/2009).

 

Regional Plan Review and Policy Analysis

Hawke’s Bay Regional Council

  • Preparation of report on implications of section 30(1)(gb) of the Resource Management Act 1991, relating to the strategic integration of infrastructure with land use, including recommendations on management options to implement it (Hawke’s Bay, 2006/2007).
     
  • Investigation and provision of advice on options for the Council to secure access to the riparian margins of some rivers and drains in Hawke’s Bay for river control, flood management and drain maintenance purposes (2004).

Hawke’s Bay Airport Authority

  • Environmental Planner.  Advisor on development and Regional Plan issues (including the Proposed Regional Coastal Environment Plan) associated with the on-going development of Hawke’s Bay Airport (2003 - 2008).

Horizons Regional Council

  • Led the Council’s policy project team and was responsible for the preparation of a large part of the proposed Hastings District Plan, including the sections relating to Subdivision, Roading Contributions, Development Levies, Reserve Contributions, Commercial Zones, Network Utilities, Heritage Items and Trees, Low Density Residential Strategy, Earthworks and Mining (including gravel extraction).  This included the preparation of reports to Council, preparation of public discussion documents and consultation with the community (1993-1998).
  • Preparation and presentation of various submissions to the Hawke’s Bay Regional Council’s draft and proposed Regional Resource Management Plan (1992 – 1997).
  • Prepared and carried out a survey of rural landowners to determine attitudes, issues, needs and desires in relation to rural “lifestyle” blocks.  The results of this survey formed part of the initial investigations carried for the preparation of rules relating to subdivision in the proposed Hastings District Plan (1993).
  • Prepared a Rural Issues Discussion Document as a follow up to the above survey.  A series of meetings in local rural community halls were held to invite feedback and to answer questions.  The results of the feedback from the document and meetings were reported to Council.  As a result of this consultation, the draft subdivision rules and low-density rural zone policies and rules were developed for the draft proposed District Plan (1993/94).
  • Review of a Ministry of Education Report on the Review of Hastings Schools, and preparation of a submission to the Minister of Education (1992).
  • Investigation, preparation and processing of various Council-initiated District Plan Changes, including Change No. 11 to the Hawke’s Bay Section of the Transitional Hastings District Plan to rezone land to the west of Flaxmere from residential, back to rural use (1992-1996).

  • Preparation of report advising of process required to have the new Arataki Link Road declared a Limited Access Road under the Local Government Act 1974 (2002).
  • Project manager for the preparation of the Council’s Engineering Code of Practice, including providing planning advice and ensuring the development of smooth linkages to the proposed Hastings District Plan (1997).

Hawke’s Bay Regional Council

  • Providing assistance to the Hawke’s Bay Regional Council’s Environmental Group by processing various resource consent applications for discharge permits, land use consents, and coastal permits (2007-2010).

Wairoa District Council

  • Preparation of a ‘global’ resource consent application to Hawke’s Bay Regional Council for in-stream works throughout the Wairoa District associated with existing culverts and bridges and relating to the Council’s road maintenance programme for the next 20 years (2010).
  • Preparation of an Issues and Options Report in relation to addressing coastal erosion issues affecting Mahia East Coast Road and Nuhaka-Opoutama Road (2010).
  • Provision of advice, training and support to the Council’s Planner (2002).
  • Provided full planning services to the Wairoa District Council when the Council’s Planner position was vacant for 2 months.  This included answering all planning inquiries and visiting the Council’s offices in Wairoa to meet with members of the public (2002).
  • Processed and prepared numerous planning reports to the Council’s Chief Executive for non-notified resource consent applications received by the Wairoa District Council (2001-2002).
  • Collated information and completed the Wairoa District Council’s response to the Ministry for the Environment’s Local Authority Questionnaire on resource consent processing and performance under the Resource Management Act 1991 (2002).
  • Processed a notified resource consent application received by the Council to subdivide rural land in the hills behind Mahia into 84 residential lots.  This included organising peer reviews of engineering information provided by the applicant and holding a pre-hearing meeting with submitters (2001-2002).

Hastings District Council (Resource Management)

  • Processed numerous notified and non-notified resource consent applications, including the preparation of planning reports for hearings and attendance at hearings (Hawke’s Bay, 1992-2001).  Some of the more significant applications included
  • Notified application by Richmond Ltd in Hastings to expand their coolstore loading area and install new roof fans (1992).
  • Private Plan Change request to rezone land on the upper faces of Te Mata Peak, Hawke’s Bay, for residential development (1993).
  • Notified application to subdivide land on Te Mata Peak, Hawke’s Bay, for a conservation park, including 54 residential lots.
  • Notified application by Craggy Range Winery to develop a winery, shop and restaurant in excess of the floor area limits in the proposed Hastings District Plan on Waimarama Road, Havelock North.

  • Preparation of resource consent application to Hastings District Council for land use consent to develop a Commercial Service Zone and General Residential Zone site at Stortford Lodge, Hastings, for a new car sales yard, showrooms and service workshop (2013-2014).

Wairoa District Council

  • Preparation of resource consent applications to Hawke’s Bay Regional Council and Wairoa District Council for the construction and maintenance of coastal protection structures along sections of Mahia East Coast Road and Nuhaka-Opoutama Road (2013).
  • Preparation of a ‘global’ resource consent application to Hawke’s Bay Regional Council for in-stream works throughout the Wairoa District associated with existing culverts and bridges and relating to the Council’s road maintenance programme for the next 20 years (2010).

  • Karituwhenua Stream Stabilisation Works: prepared application to Hawke’s Bay Regional Council for a change to the conditions of a resource consent previously granted for the work, in order to accommodate proposed changes to the stream alignment, batter slope and roughness elements (2002). 
  • Riverslea Drain, Havelock Road, Hastings: consent for urban stormwater discharge and construction of a stormwater outlet structure in the bed of the Riverslea Drain (2001).
  • Water Take for Hastings urban water supply, Brookvale Road, Havelock North (2001).

Edenz Limited

  • Prepared an application, AEE and planning evidence (including attendance at hearing) for a notified resource consent application for a coolstore expansion on the outskirts of Havelock North (2001).
  • Prepared and lodged Appeal to the Environment Court, co-ordinated technical expert investigations and evidence, and presented Planning evidence at the Environment Court Hearing (2002).

Wairoa District Council/Transit NZ/PF Olsen Ltd

  • Preparation of resource consent application, including AEE, on behalf of PF Olsen Ltd (funded by Wairoa District Council) to re-align the intersection of Tunanui Road with State Highway 2 at Morere, north of Wairoa (2002). 
  • Preparation of application pursuant to section 12 of the Historic Places Act on behalf of Transit New Zealand to destroy/modify part of an archaeological site on land adjoining State Highway 2, as a result of the above re-alignment work and widening of the seal on State Highway 2 (2002).

Telecom New Zealand Limited

  • Prepared a non-notified resource consent application and AEE to erect a Universal Street-side Cabinet on road reserve in Hikanui Drive, Havelock North.  This required an in-depth assessment of potential noise effects on nearby residential dwellings associated with the fan cooling system located within the cabinet (2001).

  • Analysis and estimate of land area requirements for development proposal in Taupo (2006).

  • Development Manager, Resource Management, Hastings District Council: Responsible for managing 23 staff, comprising of Council’s Building Officers, Environmental Health Officers and Development Planners.   Responsible for recruitment of staff, staff performance appraisals, staff discipline, budget setting, monitoring and reporting, and administering, reviewing and updating the section’s fees and charges for services (1998-2001).
  • Hastings District Council: Review of the structure of the Resource Management Division’s Environmental Health Group, identification of a restructuring proposal, reporting to Council, and its implementation (1999).

 

 

SUSTAINABLE DEVELOPMENT

MWH New Zealand Limited: member of the company’s Sustainable Development Group (also known as the “Frog Group”) and Hastings Office representative.  Assisted with developing and incorporating sustainable development principles and practices into the company’s quality assurance system. Also assisted in implementing national initiatives at the local office level (2001-2002).
